Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Flamely, including the desktop app, website, account services, cloud sync features, subscriptions, and related services.

By using Flamely, you agree to these Terms.

1. Who We Are

Flamely ("Flamely," "we," "us," or "our") is a local-first desktop time tracking app for Windows and macOS, built and operated from Lahore, Punjab, Pakistan.

2. Eligibility

You must be able to form a legally binding agreement to use Flamely. If you use Flamely on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

3. Your Account

Some features may require an account. You are responsible for keeping your login credentials secure and for all activity under your account.

You agree to provide accurate information and keep your account information up to date.

4. Local-First Product

Flamely is designed to store core tracking data locally on your device. You are responsible for maintaining access to your device, local data, and backups.

If you enable account, sync, or backup features, some data may be stored in cloud infrastructure so we can provide those features.

5. Beta Use

During beta, Flamely may be provided for free to selected testers. Beta features may change, break, be removed, or become paid later.

Beta access does not guarantee free access to paid features after beta ends.

6. Subscriptions

Flamely offers paid plans, including Pro, Business, and Enterprise tiers, with monthly and annual billing options. Plan details, prices, included features, and renewal terms are shown before purchase on the Pricing page.

By purchasing a subscription, you authorize us and our payment processor to charge the applicable subscription fees and taxes on a recurring basis until you cancel.

7. Cancellation

You may cancel your subscription through your account, the Paddle customer portal, or another method we provide.

Cancellation stops future renewals. Unless required by law or stated otherwise, cancellation does not refund fees already paid for the current billing period.

You will generally retain access to paid features until the end of the current paid billing period.

8. Refunds

Subscription payments are generally non-refundable. Please review the Refund Policy for details.

Nothing in these Terms limits any refund rights you may have under applicable law.

9. Acceptable Use

You agree not to:

• misuse Flamely or interfere with its operation;
• attempt to access another user's account or data;
• reverse engineer the app except where legally permitted;
• use Flamely to violate laws or third-party rights;
• upload malicious code;
• abuse sync, backup, or API systems;
• attempt to bypass payment, subscription, or entitlement checks.

10. Your Data

You retain ownership of your data.

You grant us the limited rights needed to provide Flamely, including processing data for authentication, sync, backup, subscription management, support, security, and product operation.

11. Privacy

Our Privacy Policy explains how we collect, use, store, and share information. By using Flamely, you agree that we may process information as described in the Privacy Policy.

12. Software License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Flamely for your personal or internal business use.

You may not copy, resell, sublicense, or commercially exploit Flamely except as permitted by us in writing.

13. Updates

We may release updates, bug fixes, or new versions. Some updates may be required for security, compatibility, sync, or subscription features.

14. Service Availability

We try to keep Flamely reliable, but we do not guarantee uninterrupted or error-free operation. Cloud services, sync, authentication, and payment features may be unavailable from time to time.

Core local tracking is intended to work offline, but we do not guarantee that all features will work without network access.

15. Third-Party Services

Flamely relies on third-party services such as Supabase and Paddle. Those services have their own terms and privacy policies.

We are not responsible for third-party services outside our control.

16. Disclaimers

Flamely is provided "as is" and "as available" without warranties of any kind, except where warranties cannot be excluded by law.

We do not guarantee that Flamely will meet your requirements, be uninterrupted, be error-free, or preserve all data in every circumstance.

17. Limitation of Liability

To the maximum extent permitted by law, Flamely and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption.

To the maximum extent permitted by law, our total liability for any claim related to Flamely will not exceed the amount you paid for Flamely in the 12 months before the claim.

18. Termination

We may suspend or terminate your access if you violate these Terms, create risk for us or others, fail to pay subscription fees, or use Flamely unlawfully.

You may stop using Flamely at any time.

19. Changes To These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of Flamely after changes become effective means you accept the updated Terms.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict of law rules.

You agree that the courts located in Lahore, Punjab, Pakistan will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of Flamely, except where applicable law grants you a non-waivable right to bring proceedings in your country of residence.
